OFFICIAL CONTEST RULES AND REGULATIONS
West 49 Fox Suzuki Moto Giveaway Contest (the "Contest")
The Contest starts on Thursday, March 11, 2010 at 12:01 PM ET and ends on Wednesday, March 31, 2010 at 11:59 PM ET (the "Contest Period").
GRAND PRIZES:
There are three (3) Grand Prizes available in this contest, each consisting of one (1) 2010 Suzuki DR-Z125L off road motorcycle, including a 4-stroke, air-cooled OHC engine and custom graphics. Approximate retail value of each Grand Prize is $3,499.00 CAD. Colour and other specifics of the Grand Prizes will be at the sole discretion of West 49 Inc., Aurora Cycle Inc. and Suzuki Canada Inc. (the Contest "Sponsors"), if applicable.
The Grand Prize Winners will personally take delivery of their Grand Prize motorcycles from the Sponsors at the Suzuki Canada Inc. motorcycle dealers nearest the winners' residences, as designated by the Sponsors within 8 to 12 weeks following the Grand Prize draw date. The Sponsors are not responsible for any costs associated with the winner's transportation to or from the Delivery Point. The Grand Prizes will not be released until the Grand Prize winners first show proof of a valid liability insurance and satisfy any other ownership requirements in their province or jurisdiction. Approximate retail value of the Grand Prize vehicles excludes all costs related to the acquisition, use or operation of the vehicle, including without limitation, all taxes, licensing, vehicle registration and insurance. The Sponsors, at their discretion, may substitute a model year 2009 or 2010 motorcycle of the same or like model and style in the event of lack of vehicle availability due to any reason. The Grand Prize winners will agree to remain in possession of the Grand Prize vehicles and retain all decals and accessories, as delivered with the vehicles, for a period of two (2) years following delivery.
SECOND PRIZES:
There are ten (10) Second Prizes available to be won in this Contest, each consisting of one (1) trip to Gopher Dunes motocross track in Courtland, Ontario for one (1) for one (1) person, including one (1) day of motocross training with Ricky Carmichael on July 19, 2010, tickets to the CMRC Canadian Nationals race on July 18, 2010, an appearance on a reality television-style webisode for West 49 TV, return economy airfare from the major commercial airport closest to the Second Prize Winner's residence (the "Departure Point") to Toronto, Ontario, local return transportation to the host hotel, three (3) nights' accommodations in Tillsonburg, Ontario. Participation in the motocross training is for one (1) person only. Approximate retail value of each Second Prize is $2,000.00 CAD, based on a Vancouver, British Columbia Departure Point. Actual retail value will vary based on Departure Point, destination and airfare fluctuations. If a Second Prize winner resides within a shorter driving distance to Courtland, Ontario than the nearest major commercial airport, then the Second Prize winner will not be eligible for the airfare portion of the Second Prize.
The Second Prize must be taken on the dates specified by the Sponsors, otherwise the Second Prize will be forfeit. Potential Second Prize winners must complete a publicity release form in order to appear as a participant in reality television-style webisode for West 49 TV and, if a potential Second Prize winner is under the age of majority in his or her province of residence, must have consent from his or her parent or guardian to travel alone and participate in Second Prize-related events. If a potential Second Prize winner, or the winner's parent or guardian, where a potential winner is under the age of majority, cannot redeem the Second Prize on the dates specified by the Sponsors or fails to provide travel consent or fails to complete the publicity release form, such potential winner will be disqualified and an alternate winner will be selected, in accordance with the "Selection Process For Second Prizes" section.
All incremental costs in using or claiming a Prize not outlined in the Prize descriptions are the sole responsibility of the Prize Winners, including but not limited to transportation, fuel, gasoline surcharges, beverages, food, gratuities, merchandise and all personal expenses of any kind or nature.
If any portion of the Prizes are not used, for any reason, no financial compensation will be awarded for the balance. The Prizes will not be awarded unless a Prize Winner, or in the event that a select entrant is a minor, his/her parent or legal guardian, has signed a Declaration and Release Form, in accordance with the "General" section below.
The Prizes in this Contest must be accepted as described in these Official Contest Rules and Regulations and cannot be transferred, assigned, changed, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these Official Contest Rules and Regulations. All incremental costs in using or claiming a Prize not outlined in the Prize descriptions are the sole responsibility of the Prize Winners.
Odds of winning a Second Prize in this Contest depend upon the number of eligible entries received. Odds of winning a Grand Prize in this Contest are one (1) in ten (10).

No responsibility is assumed by the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, as well as lost, misdirected, illegible or late entries which for any reason are not received.
This Contest is open only to legal residents of Canada, except residents of Quebec, over the age of 13 and who are residing in Canada at the time of participation in this Contest.
You are not eligible if you are an employee, representative or agent of the Sponsors, or any of the Sponsors' affiliates, subsidiaries, parent or related companies, advertising or promotional agencies or a member of the immediate family or household of any of the above persons.
The Sponsors assume no responsibility for lost, late, stolen, misdirected, mutilated, incomplete or illegible entries, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsors assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
Entries will be accepted during the Contest Period only.
On Wednesday, April 14, 2010 in Toronto, Ontario at approximately 10:00 AM ET ten (10) selected entrants will be randomly drawn from all eligible entries received for the Second Prizes available in this Contest.
The selected entrants will be contacted by telephone, mail or e-mail. In the event a selected entrant cannot be contacted within three (3) days of the selection date, another entrant will be selected in accordance with these rules.
In order to be declared the winner of a Second Prize, a selected entrant, or in the event that a select entrant is a minor, his/her parent or legal guardian, must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time limited mathematical skill-testing question to be administered at a mutually convenient time over the telephone. There will be only one opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win a Second Prize in this Contest. The procedure outlined above will be followed until the Second Prizes in this Contest have been awarded.
The selected entrant, or in the event that a select entrant is a minor, his/her parent or legal guardian, will have three (3) days to return their Release & Indemnity Form to the independent contest administrator. If the selected entrant does not return their Release & Indemnity Form within three (3) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these Official Contest Rules and Regulations.
On Monday, July 19, 2010 at approximately 4:00 PM ET at the Gopher Dunes motocross track in Courtland, Ontario, each Second Prize winner will randomly select one (1) key eligible to start a 2010 Suzuki DR-Z125L motorcycle. The entrants who are able to successfully start the engine of a 2010 Suzuki DR-Z125L motorcycle will be eligible to win the Grand Prizes.
In order to be declared a winner of a Grand Prize, a selected entrant, or in the event that a select entrant is a minor, his/her parent or legal guardian, must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time limited mathematical skill-testing question to be administered at a mutually convenient time. There will be only one opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win a Grand Prize in this Contest. The selected entrant, or in the event that a select entrant is a minor, his/her parent or legal guardian, will have twenty-four (24) hours to return their Release & Indemnity Form to the independent contest administrator. If a selected entrant does not return their Release & Indemnity Form within twenty-four (24) hours, the entrant will be declared ineligible and another entrant will be selected in accordance with these Official Contest Rules and Regulations.
All entries become the property of the Sponsors and none shall be returned. By entering this Contest, entrants indicate their consent to their personal information being stored, used and processed for purposes concerning this Contest by the Sponsors. The declared Prize Winners' information including his/her name, mailing address, telephone number and/or e-mail address, will be shared with the Sponsors and the independent contest administrator, as required to award the Prizes in this Contest.
The Prizes available in this Contest must be accepted as awarded and is not transferable and no substitutions will be made, whether in cash or otherwise, except at the Sponsors' sole discretion. The Sponsors reserve the right to substitute a Prize of equivalent or greater value, in the event that, for reasons beyond their control, the Sponsors are unable to award a Prize as described in these rules.
In the event that the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, including any network server or hardware failure, errors in programming, printing, distribution or production errors or any other errors or other causes of any nature whatsoever beyond the reasonable control of the Sponsors and/or their agencies which corrupt or affect the administration, security, integrity or proper conduct of this Contest, the Sponsors reserve the right to terminate or suspend the Contest, in whole or in part, or modify it in any way, at the Sponsors' sole discretion, without advance notice.
The Sponsors reserve the right to disqualify any individual that it finds to be in violation of these Official Contest Rules and Regulations or tampering with the Contest process. The Sponsors reserve the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsors reserve the right to seek damages or other legal remedy to the fullest extent permitted by law.
By participating in this Contest, entrants agree to comply with these Official Contest Rules and Regulations and with the decisions of the Sponsors and/or the independent contest administrator, which are irrevocable and shall be legally binding in all instances.
By participating in this Contest, the Prize Winners, or their parents or guardians, agree to sign a Declaration and Release Form in the manner prescribed herein, releasing the Sponsors, their affiliates, respective advertising and promotional agencies, and the independent contest administrator from any liability in connection with this Contest or the Prizes awarded.
By participating in this Contest, all entrants and Prize Winners agree to the use of their name, address (city and province only), photo, and/or image on videotape for publicity purposes relating exclusively to this Contest without compensation.
By accepting a Prize in this Contest, the Prize Winners absolve the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize Winners assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize.
In the event of a dispute regarding the identity of the person entering the Contest electronically, the entry will be deemed to be submitted by the "authorized account holder" in whose name the e-mail account is registered, provided that person meets all eligibility criteria of this Contest. "Authorized account holder" shall mean the natural person assigned to an e-mail address and/or telephone number, by an Internet service provider, on-line service provider, telephone service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
This Contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.
